Terms of Service
1. Acceptance of terms
By creating an account or using EatOutLog (the "App"), you agree to these Terms of Service. If you don't agree, don't use the App.
2. The service
EatOutLog lets you log dishes you've ordered at restaurants, rate them, attach photos, and follow other users to see their check-ins.
3. Accounts
You sign in through a third-party authentication provider. You're responsible for keeping that account secure, since it controls access to your EatOutLog account.
4. Your content and the license you grant us
You keep ownership of the ratings, notes, and photos you submit ("Your Content"). By posting Your Content, you grant EatOutLog a worldwide, non-exclusive, royalty-free license to store, display, and aggregate it within the App, including alongside other users' content to show aggregate ratings for a restaurant or dish, and to use it in connection with future features, such as providing a verified restaurant owner with aggregated, anonymized insight into ratings for their restaurant. This license does not transfer ownership of Your Content, and does not permit selling Your Content on its own to third parties.
5. Ratings are a permanent record
Check-ins and ratings reflect what a user actually experienced. To keep that record trustworthy, restaurant owners cannot remove or edit a user's rating, even for a restaurant they've claimed or been verified as the owner of. Ratings can only be removed by EatOutLog under our content moderation policy (Section 6) or at the request of the user who posted them.
6. Content moderation
We may remove content or suspend accounts that violate these Terms: for example, illegal content, spam, harassment, or fake/fraudulent check-ins. This moderation right is separate from Section 5: it's about policing abuse of the platform, not giving restaurant owners a way to take down ratings they simply disagree with.
7. Acceptable use
You agree not to:
- Post content that's illegal, harassing, or infringes someone else's rights.
- Submit fake check-ins or manipulate ratings.
- Attempt to circumvent a device ban or account suspension.
- Use the App to collect other users' data beyond what the App itself displays to you.
8. Photos of other people
If a photo you post incidentally includes other people (for example, other diners in the background), you're responsible for having the right to post it. Don't post photos specifically intended to identify or embarrass someone else.
9. The app and your license to use it
EatOutLog is a product of Capypine LLC. The EatOutLog name, logo, and app itself (excluding Your Content) are owned by Capypine LLC. You may not use our branding without permission.
We give you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device you own or control, for your own personal, non-commercial use. This license covers every update we release, and some features may need the current version to keep working. It ends when you stop using the App or when we terminate your account under these Terms.
You agree not to:
- Copy, modify, or create derivative works of the App.
- Reverse engineer, decompile, or disassemble the App, except where the law doesn't allow this restriction.
- Rent, lease, sell, sublicense, or otherwise transfer the App to anyone else.
- Use the App to build a competing product or service.
The App includes third-party software under its own licenses, and these Terms don't limit your rights under those licenses. If you got the App from the Apple App Store or Google Play, that store's own terms also apply to your download.
10. Disclaimers
The App is provided "as is." Ratings and check-ins reflect individual users' opinions, not verified facts about a restaurant or dish, and we don't guarantee their accuracy.
11. Limitation of liability
To the maximum extent permitted by law, EatOutLog is not liable for indirect, incidental, or consequential damages arising from your use of the App.
12. Termination
You may stop using the App and request account deletion at any time. See our Data Request page (account deletion is not available inside the App itself). We may suspend or terminate accounts that violate these Terms.
13. Governing law
Jurisdiction to be determined with legal counsel.
14. Changes to these terms
If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in the App.
